The 6th International theoretical and practical conference on compulsory enforcement of judicial acts and acts of other authorised bodies was held from 8 to 10 September 2015 in the capital of Republic of Buryatia, Ulan-Ude (Russian Federation) on the topic of “Restriction of debtor's rights: novels of legislation and practical application”.

Organisers of the Conference were the Federal Judicial Officers Service of the Russian Federation together with the Buryatia State University, the Russian Law Academy of the Russian Ministry of Justice and the Association of legal education.

The UIHJ was represented by its President, Françoise Andrieux, its 1st Vice-President, Marc Schmitz, and its Treasurer, Juraj Podkonický.

As in previous years, the event was perfectly organised by the Federal Judicial Officers Service of the Russian Federation whose Director is Artur Olegovich Parfenchikov, Chief Judicial Officer of the Russian Federation.

Indeed, over the past years five conferences already took place, in Saint Petersburg, Kazan, Voronezh, Ekaterinburg and Vladikavkaz. Previous conferences discussed urgent problems of development of legal enforcement and participants had the chance to exchange opinions on different systems of legal enforcement, on suitability of adopting new measures to influence debtors, and to analyse and assess efficiency of current mechanisms of legal enforcement.

The conference has proved to be a key event as interest grows every year. Leading Russian and foreign experts in the sphere of enforcement proceedings took part in the work of the conference, as well as political and public figures, officials, representatives of banking community and other organisations. Among them were representatives of enforcement bodies of 21 countries: Armenia, Azerbaijan, Belarus, Belgium, Bulgaria, Czech Republic, Estonia, Finland, France, Germany, China, Iran, Kazakhstan, Lithuania, Moldavia, Mongolia, Montenegro, Russian Federation, Slovakia, Slovenia and Serbia.

The suspension of driving license for non-payment of alimonies was discussed. This relatively new method of enforcement is already in force in several states. In the Russian Federation, this proposal is discussed before the State Duma, and, among others, the inclusion of experiences in such matters having being carried out in the Czech and Slovak Republics. The present statutory framework to suspend driving licenses is also extended to bans to leave the boarder of the Russian Federation, the issuing of a hunting or fishing license, firearms permit, the issuance of building permits, as well as prohibition of internet connection or banning the sale of SIM cards (both in Russia and other countries of the Community of Independent States (CIS), the SIM card can be purchased only on presentation of an identity card). These prohibitions can apply partially or all together. The Russian Federation continues statutory regulation of the deadline for voluntary compliance by the debtor within cinq days from the receiving of "enforceable decision".

President Andrieux spoke about this topic of limiting the debtor rights in consideration with the general principles of court and enforcement proceedings: before trial (access to justice, provisional measures), during trial (representation of parties), and after trial (appeal, enforcement).

The Ulan-Ude conference was a great success with many participants present. The 7th International conference will be held in June 2016 in the capital of Baskiria, Ufa. The UIHJ is looking forward to this major international event.
